Everything on the website information and material from Inside Edge Experience Pty Ltd ABN 64 605 967 619 and will be referred to as “we”, “our” and “us” throughout our policy. Your access to and use of the information, materials and services provided on our website is conditional upon your acceptance and compliance with the terms, conditions, notices and disclaimers contained on our website (“Terms”). Your use of our site will mean you accept these Terms. If you do not agree to these Terms, do not use our website. We may revise these Terms at any time by updating our posting, and your use afterwards signifies your acceptance of the changed Terms. Please check these Terms periodically for changes.
We offer and provide the user a range of content and tools, including; online mentoring, a blog with theories and tips, videos, graphics, training plans, fitness programs, nutritional programs and other materials referred to as “Content”.
We own all the proprietary rights and intellectual property rights on this website and the content including, but not limited to, copyright. All of the content, intellectual property rights in the content, and other intellectual property on the website and associated with the website are owned by us and are available for your personal use only. You must not download or redistribute any of the content on the website.
You must not, and you must not allow others to copy, modify, alter, download, publish, broadcast, reproduce, film or record, distribute, rent, licence, sell, transfer or edit any of the content or the website or any part of it unless expressly provided for in these Terms or with our express written permission. All rights not expressly granted herein are reserved. Downloading of any information, content or images from our website, or from any of the Content, does not transfer any right or ownership of such information, content or images to you and such information, content or images may be used solely in accordance with these Terms. All copyright and other proprietary notices contained in downloadable materials must be retained.
While we provide a range of content for free, to access our programs and services you must register as a member and pay the fee in advance for the service that you select. Reference to “membership” in these terms and conditions include one-off purchases of access to content as well as ongoing subscriptions for access to content. Each membership course or program will be sold separately from one another and membership to one program doesn’t grant access to another. As a member of a program or course, where advised you are permitted to temporarily download one copy of the content or materials outlined in the membership onto a single computer for your personal, non-commercial use only.
DELIVERY POLICY
Members of any online program will be delivered the program or course, upon subscription, via email. The program will be delivered to your specified email address on a weekly basis with videos, links, PDF’s & worksheets attached. People using the 1 to 1 in-person mentoring service will pay at the completion of the session.
REFUND POLICY
Should you be unhappy with the online program after the first 14 days, you will be refunded in full without any questions asked.
MINORS
Our website is a general audience site. Minors should always ask their parents or guardians for permission before providing any contact information to anyone online. We urge parents and guardians to participate in their children’s online activities and use parental control or other web filtering technology to supervise children’s access to the Internet.
YOUR PRIVACY
We regard your privacy as important. Should you enter any personal information on our website, it will not be used by or distributed to any third parties. You agree that the use of your personal information may be used with your prior permisson for marketing campaigns or offers by Inside Edge Experience Pty Ltd ABN 64 605 967 619 (trading as Cricket Mentoring).
FITNESS LEVEL
You require a moderate level of fitness to follow the strength & conditioning programs and the like set out in our information service. Persons with pre-existing medical conditions, in poor health, or with any concerns as to commencement of a new fitness regime should consult with an appropriate healthcare professional before beginning any of these programs. You are responsible to make your own inquiries and seek independent advice from a healthcare professional before acting on any information or material made available to you through our Website. The information on the Website may not be suitable to your particular circumstances and is not a substitute for obtaining specific advice from a qualified health care professional. You acknowledge that the service that we provide on the Website is an information service only, and that you are solely responsible for (at your own discretion) following (or not following) any exercise program or regime that we provide as part of the information service. Our service does not include any supervision or monitoring of your activity, and we are not responsible for any injuries that you may suffer as a result of following the exercise program or regime. To the extent we supply any “recreational services” or “recreational activities” (within the meaning of the Competition and Consumer Act (2010) (Cth) or any State or Territory civil liability or consumer protection legislation), you acknowledge that your participation in the recreational services and activities may involve risks, including personal injury and death. Prior to participating in the recreational services and activities, you must assess all the risks involved, including risks that may be caused by your own acts or omissions, your health condition, those of other users of the Website and risks that are not known to you or are not readily foreseeable at the time of participating in the recreational services and activities. By participating, you are doing so voluntarily and at your own risk. To the extent permitted and required by law, this is a risk warning pursuant to the various civil liability and consumer protection legislation. You assume all risks in connection with your participation in any recreational services and activities that we may provide. To the maximum extent permitted by law, we exclude all liability arising from or in connection with any recreational services or activities for: (1) death; (2) physical or mental injury (including the aggravation, acceleration or recurrence of such an injury); (3) the contraction, aggravation or acceleration of a disease; and (4) the coming into existence, the aggravation, acceleration or recurrence of any other condition, circumstance, occurrence, activity, form of behaviour, course of conduct or state of affairs: (a) that is or may be harmful or disadvantageous to you or the community; or (b) that may result in harm or disadvantage to you or the community, resulting from the supply of recreational services or recreational activities, but we do not exclude our liability to significant personal injury which is caused by our reckless conduct in the supply of recreational services or activities
